Dispute Resolution and Litigation

Trowers & Hamlins is a City-led, international and national law firm with over 170 partners and 1000 staff. With offices across the UK, Middle East and Asia. Our global footprint is further enhanced by our strategic partnership with Interlaw which works to facilitate our management of multi-jurisdictional matters. We have leading practices in Corporate, Litigation, Tax, Banking and Finance, Real Estate and Private Wealth.

We've always been proud of our commitment to equity, diversity and inclusion and value the variety of our partnership. We are different and we believe it is our people that make us unique. We expect and respect that you and your talents are too. Our strategic direction is shaped by a desire to grow our business in a way that is responsible and sustainable and has the principles of ESG at its core, guiding the way we operate firmwide.

The Property Disputes Team

We provide a fully integrated real estate dispute resolution legal service for clients which works closely alongside our national projects, real estate, construction and litigation teams.

We act for all principal stakeholders across a range of real estate sectors, including residential and commercial property developers and property companies, title indemnity insurers, institutional pension funds, receivers and insolvency practitioners, housing providers, private investors, entrepreneurs and occupiers of commercial and residential property.

Our specialisms include: strategic advice to portfolio owners on contentious matters; rights to light; easement and restrictive covenant disputes and other real property matters; the full range of commercial landlord and tenant including lease renewal, alienation, rent review, dilapidations and other general breach of covenant matters; leasehold enfranchisement (acting for both landlords and tenants); all areas of residential landlord and tenant, with a particular emphasis on residential service charge disputes and tenancy enforcement; telecommunications; and all aspects of property related insolvency.

We take a pragmatic approach to disputes, seeking to resolve these in the most efficient manner possible, and always tailored to the client’s objectives

What you'll be doing

  • You will be involved with a range of work principally including commercial portfolio and development related disputes and strategic advice for landowners, developers and local authorities.
  • Commercial landlord and tenant matters (eg 1954 Act, alienation, break rights, dilapidations), disputes concerning property contracts, property related insolvency (both real property and landlord and tenant), other real property related disputes, such as rights of way, adverse possession and restrictive covenants.

  • Due to the breadth of the real estate practice at Trowers, there is scope over time to become involved in most issues that ever touch property disputes.
  • You will handle proceedings in all levels of Courts and Tribunals, and be involved in without prejudice settlement processes including formal mediations.
  • Building and maintaining effective relationships with clients and market intermediaries.
  • Proactive participation in individual, team and office-based business development initiatives.
  • Participation in firm-wide and departmental meetings, training sessions and social events.
  • Delegating client work effectively to more junior fee-earners as appropriate and contributing to their development.
